How to Buy Property in Marbella with Cryptocurrencies: Swap or Classic Transaction?

🔁 1. Swap (Permuta) – Asset-for-Asset Exchange

(when the seller directly accepts crypto)

In the European Union, cryptocurrencies are not considered legal tender but digital assets. This means that if the seller agrees to receive payment in crypto (e.g. BTC, ETH, USDT), the transaction is legally structured as an asset exchange, known as a “permuta”.

✅ How it works:

  • The property value is agreed in euros.
  • You transfer the cryptocurrencies directly to the seller’s wallet.
  • At the notary, a swap contract is signed, not a sale–purchase agreement.
  • The deed specifies that you are providing a digital asset in exchange for a real estate asset.

  • Proof of ownership of the crypto wallet is required.
  • Full KYC/AML checks are carried out (identity, source of funds).
  • The notary must have experience with this type of transaction — only a few can handle it correctly.

💶 2. Classic Transaction via a Broker

(when the seller wants euros)

If the seller does not accept crypto but you only hold digital assets, you can use a specialized crypto–fiat broker.

✅ How it works:

  • You transfer your cryptocurrencies to the broker’s wallet.
  • The broker converts them into euros.
  • The euros are transferred to the seller’s bank account.
  • At the notary, a standard sale–purchase contract is signed, with the price expressed in euros.

  • The seller receives euros directly, with no complexity.
  • You maintain discretion — the seller does not even need to know the funds originated from crypto.
  • The transaction is fast, legal, and clean from a tax perspective.

💸 Costs:

  • The broker charges a commission of 2–3% of the transaction value for this service.
